Application to court by the Claimant for an order pursuant to the Municipal Act, R.S.B.C. 1911, c. 170, s. 399, compelling the Authority to appoint an arbitrator for the purpose of determining compensation payable to the Claimant. The Authority had commenced expropriation proceedings on April 4, 1912 pursuant to the Act with the intention of acquiring part of the Claimant's land for a lane. However, it later decided to abandon the taking and did not appoint an arbitrator. The order was granted. |
