Application by the expropriating authority to set aside an arbitration award of compensation following an expropriation conducted pursuant to the Highway Act, R.S.B.C. 1979, c. 167. Partial taking of farm land for highway purposes. The arbitrators had awarded $225,520 in compensation plus interest for market value of the land taken and disturbance damages. The Petitioner alleged that the arbitrators had misconducted themselves in writing the award and that they had failed to set off certain benefits from construction of the new highway alignment against compensation otherwise payable. The application was dismissed. |
