Decision: Appeal by the Province and cross appeal by the Respondent, a property owner, from an arbitration award of compensation in a dispute involving the Province's acquisition of the Respondent's property. The Respondent owned land that was included in a Restricted Development Area imposed by the Province of Alberta. The Respondent alleged that his land had been constructively expropriated and alternatively, that the Authority had committed the tort of abuse of public office. The arbitrator rejected the constructive expropriation claim but found that the tort of abuse of public office had been committed and awarded damages. Both appeals were dismissed.
