Application by the Claimant to the British Columbia Expropriation Compensation Board pursuant to the Expropriation Act, S.B.C. 1987, c. 23 for an interim award of costs. During the course of the hearing the parties agreed on the matters in dispute and the hearing was adjourned without order of the Board. Approximately nine months later, counsel for the Claimant contacted the Board to inquire when the Board intended to release its decision. After reviewing a transcript of the earlier proceedings and receiving submissions from the parties, the Board held that the matter had been settled between the parties at the original hearing and the Claimant's application was dismissed. |
