Decision: Appeals by the Claimants and the Authority from an award of compensation by a valuator appointed pursuant to the British Columbia Hydro and Power Authority Act, S.B.C. 1964, c. 7. The Authority had expropriated a fee simple interest in a 36.6 ac. portion of the Claimants' land for purposes of a hydro-electric power project on the Kootenay River. Prior to the taking, the Claimants' land totalled approximately 191 acres. The valuator had awarded $47,601.00 in compensation. On appeal, the court awarded $44,182.00 plus statutory interest for market value of the land taken and the reduction in market value of the remainder. The parties were ordered to bear their own costs and to share the cost of the Official Court Reporter equally.
