Appeal by the expropriating authority from the refusal of the lower court to set aside an award of compensation made by a panel of arbitrators appointed pursuant to the Highway Act, R.S.B.C. 1960, c. 172. At issue was whether the arbitrators had acted properly by including an item for interest in determining the compensation award. It was held that the arbitrators had jurisdiction to do so. The appeal was dismissed. |
