Action for damages in nuisance against both an airport operator and the federal government. Claimants owned property located under the flight path for a new runway at Vancouver International Airport. The airport authority did not acquire any interest in the claimants' property prior to commencement of aircraft operations. The court found that the claimants were affected by excessive aircraft noise which was sufficient to constitute a nuisance. The defence of statutory authority was rejected. Damages were awarded for loss in market value and relocation costs. |
