Application by the Claimants to the British Columbia Expropriation Compensation Board for a final cost review pursuant to s. 44 of the Expropriation Act, S.B.C. 1987, c. 23. The costs arose from a partial expropriation of land located in Parksville. The parties had settled all claims except for costs. At the cost hearing the Claimants presented accounts for legal, appraisal and other costs totalling $401,000 net of taxes. After a number of adjustments, the Board awarded $123,232.98 for legal accounts, $21,425 for appraisal accounts and $45,000 for business valuation accounts. The total award net of taxes and interest was $189,657.98. Interest was awarded on the unpaid professional accounts. Leave was granted to make a further application for an award of costs for participation in the present cost review. |
