Decision: |
Two appeals by the owners and a cross appeal by the expropriating authority from the findings of two valuators appointed pursuant to the British Columbia Hydro and Power Authority Act, S.B.C. 1964, c. 7. The valuators were appointed following the expropriation of two rights of way for electric transmission line purposes over land owned by the Claimants near Sparwood. The rights of way acquired by expropriation totalled 37.65 ac. and the four parent parcels totalled about 700 ac. The valuators had fixed compensation in the aggregate at $17,642. The owners presented evidence supporting a claim of $79,000. The authority proposed a valuation of $10,512. The court awarded $15,867 plus interest. Each party was ordered to pay their own costs except for the Court Reporter whose cost was ordered to be shared equally. |
