Decision: Appeal and cross-appeal from the finding of a valuator appointed pursuant to s. 23 of the Hydro and Power Authority Act, R.S.B.C. 1979, c. 188. The valuator's appointment resulted from the expropriation of a 20.56 ac statutory right of way for an overhead electric transmission line through the Appellant's property located near Fernie. The valuator had fixed compensation in the amount of $75,000. The Appellant sought compensation in the amount of $135,000 and the Respondent expropriating authority had proposed a payment of $24,000. The court awarded $58,000 in compensation plus interest. There was no order as to costs.
