Decision: Appeal from a judgment which set aside portions of an arbitration award of compensation following an expropriation. The portions at issue dealt with whether pre-expropriation losses were recoverable and whether interest on the award should be compounded. On appeal it was held, McLachlin J.A. dissenting, that pre-expropriation losses were not recoverable and that interest should not be compounded. The appeal was dismissed.
