Preliminary application by an owner to prevent an expropriating authority from seeking a reconsideration of an arbitrator's award of compensation made following an expropriation conducted pursuant to the Highway Act, R.S.B.C. 1979, c. 167. The Respondent owner alleged that a reconsideration would, in effect, be an appeal and that the statutory provision permitting a court to require a reconsideration had been repealed by new legislation. The old legislation was found to remain applicable to this case and the Respondent's application was denied. |
