Application by the Respondent to the British Columbia Expropriation Compensation Board for an order dismissing the compensation claims advanced by the Claimants pursuant to the Expropriation Act, S.B.C. 1987, c. 23. In the alternative, the Respondent applied for certain orders to compel further and better discovery of the Claimants' case. The Respondent also applied for an adjournment of the compensation hearing and an order imposing an interest penalty on the Claimants for delay. Partial taking from two properties for a highway widening project. One of the subject properties was developed with a restaurant. The Board found that the Claimants had unreasonably delayed in responding to the Respondent's discovery requests. It ordered production of a list of documents and an affidavit. It further ordered that the Claimants be deprived of interest during a specified delay period. The Claimants were also denied their costs of this application. |
