Decision: Appeal by an expropriating authority from a decision of the Ontario Divisional Court upholding a compensation award made by the Ontario Land Compensation Board pursuant to the Expropriations Act, R.S.O. 1970, c. 154. The award was made for injurious affection to the Respondents' land caused by construction of a new highway on adjacent land. No land was taken from the Respondents. The appeal was allowed and the compensation award set aside. No costs were awarded.
