Decision: Application by a property owner for an order appointing an arbitrator pursuant to the Medicine Hat City Charter, S.A. 1906, c. 63. The Applicant alleged that the City of Medicine Hat had lowered the grade of the street adjacent to his property which removed access to the street and caused damage to his property. It was held that the actions of the City were not authorized by the Charter and the court had no jurisdiction to appoint an arbitrator. The action was dismissed with costs to the City.
