Decision: |
Application by the Claimants to the Alberta Land Compensation Board for an order directing the continuation of a compensation hearing pursuant to the Expropriation Act, R.S.A. 2000, c. E-13. The Claimants had owned a parcel of land that was expropriated by the City of Edmonton in 2005. A compensation hearing into this matter was commenced and adjourned in 2010 after the Board heard evidence that a settlement agreement had been reached between the parties. Subsequently the Board made a determination that a settlement had been reached and this determination was upheld on appeal. The present application for continuation was dismissed. However the Board noted that it still retained jurisdiction to hear and determine costs. |
