Application by the Respondent expropriating authority to the Alberta Land Compensation Board for an order determining that a settlement agreement existed between the parties. The Respondent expropriated land from the Claimants on February 15, 2005 pursuant to the Expropriation Act, R.S.A. 2000, c. E-13. During the compensation hearing a dispute arose as to whether a settlement agreement had been reached between the parties. The compensation hearing adjourned at that point. Subsequently the Board held that it had jurisdiction to determine whether a settlement agreement existed. The present hearing was conducted to determine the merits of this issue. The Board found that a settlement had been reached. The application was granted. |
