Decision: Application to the Alberta Land Compensation Board for determination of compensation pursuant to the Expropriation Act, R.S.A. 2000, c. E-13. Partial taking of a 0.50 ac. portion of a 2.23 ac. parent parcel of land located in the Town of Gibbons. The land was taken for a street extension project. The Respondent made an advance payment of $67,300 to the Claimant. Prior to commencement of the hearing the parties reached an agreement that the subject property was worth $100,000 per ac. so the issue before the Board was the amount if any for reduction in market value of the remaining land. The Board found that the remainder parcel had been reduced in value by 10%. It awarded $50,000 for the land taken and $17,300 for injurious affection. Since the award matched the amount of the advance payment no interest award was made.
