Application by the Claimant to the Alberta Land Compensation Board for determination of compensation pursuant to the Expropriation Act, S.A. 1974, c. 27. Partial taking of 3.73 ac. of land for a highway project. The subject property was located in the Municipal District of Sturgeon. The Board awarded $280,000 less advance payments for market value of the land taken plus interest at 9.5% per annum compounded annually. The Board also awarded costs to the owner except in relation to preparation for and attendance at a hearing on September 18, 1978 where special circumstances were found to exist justifying denial of costs to the owner. |
