Application for determination of compensation pursuant to the Expropriation Act, R.S.A. 2000, c. E-13. Two separate actions were heard together. Partial taking of land to accommodate a highway re-alignment. It was held that recent sales of land by the Plaintiffs to a highway contractor should be disregarded in valuing the land taken. The court awarded compensation based on $700 per acre in one case and $800 per acre in the other case. A disturbance damage claim for loss of well access payments was dismissed. |
