Decision: |
Joint application by both parties to the Alberta Land Compensation Board for a determination as to whether a compensation hearing pursuant to the Expropriation Act, R.S.A. 2000, c. E-13, should be adjourned. At the time this application was heard the compensation hearing had commenced. After proceeding with the hearing for five days the panel was informed that a dispute had arisen between the parties as to whether a settlement had been reached. New counsel for the Claimant appeared and the Board was asked to determine whether it had jurisdiction to determine if a settlement had been achieved. It was held that the present panel of the Board would not decide this issue and the compensation hearing should reconvene on a date to be determined by the Board Administration. |
