Decision: |
Application by the Claimants to the Alberta Court of Queen's Bench for determination of compensation pursuant to the Expropriation Act, R.S.A. 2000, c. E-13. Partial taking of a strip of land 32 acres in size from two parent parcels. The land was taken to permit the widening of Highway 15 east of Fort Saskatchewan. The Authority made two advance payments totalling $108,159. The court awarded $176,164 for market value of the land taken and $34,118 for loss in value to the remainder due to changes in access. The award totalled $210,282 less the advance payment for a net award of $102,123. |
