Application to court by the Claimant for an order appointing an arbitrator pursuant to the Arbitration Act, R.S.B.C. 1911, c. 11. The Authority had re-graded Third Street adjacent to the Claimant's property located in the City of North Vancouver. The Claimant sought compensation pursuant to the Municipal Act, R.S.B.C. 1911, c. 170. However, the Authority denied liability and refused to appoint an arbitrator. The Authority alleged that the Claimant held an unregistered interest as a purchaser and as such was not entitled to advance a claim for compensation. It was held that the Claimant's interest in the land was sufficient to permit the Claimant to advance the claim. An arbitrator was appointed. |
