Decision: Application by an expropriating authority to the Nova Scotia Utility and Review Board for an order dismissing the Claimant's claim for compensation made pursuant to the Expropriation Act, R.S.N.S. 1989, c. 156. The Authority had constructed highway improvements in the vicinity of the Claimant's property in the City of Halifax. The Claimant operated a car dealership on the subject property. Although the highway remained open during construction, the work resulted in interruption of traffic flows which caused a business loss for the Claimant. The Board held that the project did not produce a direct interference with access to the subject property. The claim for compensation was dismissed.
