Decision: Appeal by the City of Vancouver from a lower court decision dismissing an application to set aside an arbitration award. The action arose out of an expropriation by the City pursuant to expropriation powers granted by the False Creek Reclamation Act, S.B.C. 1911, c. 56. In determining the market value of the land taken, the arbitrator had treated the subject property as though it was waterfront property to which certain riparian rights applied when that was not the case. The appeal was allowed and the arbitration award set aside.
