Decision: Appeal from a lower court decision dismissing an appeal by the Authority from a valuator's award of compensation. The Authority had expropriated all of the assets of the Claimant which operated an electric utility on Vancouver Island. The expropriation was carried out pursuant to the Electric Power Act, S.B.C. 1945, c. 27. The Authority's appeal was dismissed by the lower court on the basis that the notice of appeal had been filed out of time and the court was without jurisdiction to hear the appeal. The present appeal was dismissed.
