Application for an order compelling the Defendant to appoint an arbitrator for the purpose of determining compensation payable to the Applicant for land taken by the Defendant for road purposes. The land had been taken five or six years prior to commencement of this application. It was held that the one year limitation found in the Municipal Clauses Act, R.S.B.C. 1897, c. 144, s. 244, was applicable and the application was out of time. The application was dismissed with costs to the Defendant. |
