Decision: Appeal by the owners from a compensation award made by the Exchequer Court following an expropriation pursuant to the Expropriation Act, R.S.C. 1952, c. 106. The expropriating authority had acquired 972 acres of land from the Appellants for purposes of a national park. The subject property was located on Graham Island, one of the Queen Charlotte Islands. At trial the Appellants were awarded $30,000. On appeal the court held that the compensation award should be increased to $40,000. The appeal was allowed with interest and costs to the Appellants.
