Application by the Claimants to the British Columbia Expropriation Compensation Board for determination of compensation pursuant to the Expropriation Act, R.S.B.C. 1996, c. 125. The Authority acquired a statutory right of way from the Claimant for an existing sewer pipeline. The acquisition was carried out by way of an agreement made pursuant to s. 3 of the Act. Prior to the hearing, the Authority had paid $121,000 as an advance payment on account of compensation. The Board awarded $165,073 for market value of the interest acquired and $43,703 for disturbance damages. The award totalled $208,776 before allowance for the advance payments. Costs and interest were also awarded. |
