Application by a property owner for determination of compensation payable following an expropriation conducted by the Respondent pursuant to the Municipal Expropriation Act, R.S.S. 1978, c. M-27. Full taking of a parcel of land located in the City of Regina and developed with two commercial buildings. The land was taken for a highway project. The court awarded compensation in the amount of $375,199 for market value of the land taken and $194 for the salvage value of certain chattels left on the property after the Respondent took possession. The court also allowed a set-off against the compensation award for property tax paid by the Respondent which was applicable to the period while the Claimant was in possession. Interest was also awarded. Each party was required to pay its own costs. |
