Application by a mineral claim holder to the British Columbia Surface Rights Board for an order allowing use of a road located on land owned by the Respondent and for an order fixing compensation payable. The application was made pursuant to s. 10 of the Mining Right of Way Act, R.S.B.C. 1996, c. 294. It was held that the road in question was not an existing road for purposes of the Act and therefore the Applicant did not have a right to use the road and the Board did not have jurisdiction to settle compensation. The application was dismissed. |
