Application by an expropriating authority to the Alberta Land Compensation Board for an order setting a date for a hearing to determine compensation payable following the acquisition by the authority of land from the Respondents pursuant to the Expropriation Act, R.S.A. 1980, c. E-16. The acquisition was carried out pursuant to an agreement under s. 30 of the Act. The agreement provided that either party could apply to the Board for determination of compensation and the Applicant did so. The Board found that it did not have jurisdiction to determine compensation in this case and the application was dismissed. Costs were awarded to the Respondents. |
