Complaint brought by a land owner following a replot carried out pursuant to the Municipal Act, R.S.B.C. 1979, c. 290. A 10.1 ac. parcel of land was taken from the Claimant for the replot. The Claimant received two parcels totalling 10.67 ac. upon completion. The Claimant alleged that the land received was less valuable than the land contributed. The Claimant sought damages in the amount of $252,000. The Commissioner appointed to hear the complaint awarded damages in the amount of $75,767 plus interest at 6%. |
