Appeal by an expropriating authority from an arbitration award of compensation following an expropriation conducted pursuant to the British Columbia Railway Act, R.S.B.C. 1897, c. 163. The subject property was located in Surrey. The Appellant had expropriated an easement from the subject property for an overhead electric transmission line. The Appellant had offered to pay the sum of $2,508. Two of the three arbitrators awarded the sum of $17,889.25. On this appeal the court awarded the amount previously offered by the Appellant being $313.50 for the easement and $2,194.50 for damages for a total award of $2,508. |
