Decision: Appeal by a property owner from a compensation award made by the Alberta Land Compensation Board pursuant to the Expropriation Act, R.S.A. 1980, c. E-16. Partial taking from a property located in Red Deer. At the date of expropriation the subject property was developed with a commercial building occupied by a furniture store. The land was taken for highway purposes. At issue on the appeal was the amount of the reduction in market value to the remaining land. The Board had based its award for this item on 1% of the market value. On appeal this award was increased to 5% of the market value. The appeal was allowed. Costs were awarded to the Appellant.
