Decision: Appeal by a property owner from the reversal by the Court of Appeal of an injunction granted by the trial court. The Appellants owned property in the City of Vancouver on which was constructed a wharf used in the Appellant's business. The Respondents planned to construct a seawall on the foreshore adjacent to the wharf which would have blocked access to the wharf from the ocean. It was held that the Respondents did not have lawful authority to construct a seawall that interfered with navigation as it would in this case. The appeal was allowed and the injunction restored.
