Appeal by the licensees and cross-appeal by the owners from an arbitrator's award of compensation made pursuant to the Water Act, R.S.B.C. 1979, c. 429. At issue was whether the Act permitted an award for injurious affection and whether the arbitrator had jurisdiction to prescribe a route for the water pipeline easement through the owner's lands which was different than the route authorized in the water licence. The court held that injurious affection was a proper component of a compensation award and that the arbitrator did not have jurisdiction to prescribe a different route for the pipeline. |
