Application by the Claimant for an order setting aside an arbitrators' award of compensation. The arbitration panel had been constituted pursuant to s. 544 of the Vancouver Charter, S.B.C. 1953, c. 55 to determine the amount of compensation, if any, payable for injurious affection to the Claimant's property. The claim arose from construction of a new Granville Street bridge in the City of Vancouver. A ramp narrowed the width of the street immediately in front of the Claimant's property. The arbitrators awarded $9,400 but did not provide reasons or any indication of how the amount was arrived at. There was evidence before the court on the present application that the award equalled 10% of the market value of the affected land. It was held that the arbitrators had not erred and the application was dismissed. |
