E-13, for an order that the proposed payment be made to the Land Compensation Board. Expropriation of a 4.38 ha. parcel of land. The subject property was encumbered by a builder's lien and a Lis Pendens. At the hearing of this application, the registered owners provided evidence that the builder's lien and Lis Pendens had just been lifted. It was held that the proposed payment should be made to the two registered owners. Costs were awarded to the Claimants in the amount of $1,500.00. |
