Appeal by the Authority from a lower court order directing the Authority to appoint an arbitrator to hear and determine a claim for compensation pursuant to the Municipal Act, R.S.B.C. 1911, c. 170. The Authority had lowered the grade of the street adjacent to the Claimant's property and the Claimant had made a claim for compensation for injurious affection. It was held that the lower court order had been made without jurisdiction and was set aside. |
