Decision: |
Appeal by an expropriating authority from a compensation award made by a County Court judge sitting as an arbitrator pursuant to the Public Utilities Act, R.S.O. 1937, c. 286 and the Municipal Act, R.S.O. 1937, c. 266. Partial taking of an 83 ac. portion of a 200 ac. farm property. The arbitrator had awarded $20,000 in compensation. On this appeal, it was held that the Claimants were entitled to $5,000 for market value of the land taken, $4,000 for injurious affection and a $500 allowance for forcible taking for a total award of $9,900. Costs were awarded to the Authority. |
